Faktor Penerapan sifat War’a

War’a diaplikasikan Karena ke-tidak-jelasan hukum, apakah perbuatan itu halal atau haram. Dikarenakan ada beberapa alasan, di antaranya:

1.    Masih tersembunyi dalil syar’i.

2.    Terjadi pertentangan dalil-dalil dan sama kuat antara dalil-dalil.

3.    Ada keraguan tentang ada sebab diharamkan atau dibolehkan.

4.    Adakala karena keluar dari perselisihan pendapat.

HUKUM WAR’A

Menurut Al-Qarafi bahwa War’a hukumnya Sunat.[1]

Sebagai dalil yaitu hadits

عَنْ أَبِي عَبْدِ اللهِ النُّعْمَا نِ بْنِ بَشِيْرٍ رَضِيَ اللهُ عَنْهُمَا قَا لَ سَمِعْتُ رَ سُوْ لَ اللهِ صَلَّى اللهُ عَلَيْهِ وَ سَلَّمَ يَقُوْ لُ : إِنَّ الْحَلاَ لَ بَيِّنٌ وَإِنَّ الْحَرَامَ بَيِّنٌ وَبَيْنَهُمَا أُمُوْ رٌ مُشْتَبِهَا تٌ لاَ يَعْلَمُهُنَّ كَثِيْرٌ مِنَ النَّا سِ، فَمَنِ اتَّقَى  الشُّبُهَا تِ فَقَدْ اسْتَبْرَأَ لِدِ يْنِهِ وَعِرْ ضِهِ، وَ مَنْ وَ قَعَ فِي الشُّبُهَا تِ وَ قَعَ فِي الْحَرَا مِ، كَا لرَّاعِي يَرْعىَ حَوْ لَ الْحِمَى يُوْ شِكُ أَنْ يَرْ تَعَ فِيْهِ، أَلاَ وَ إِنَّ  لِكُلِّ مَلِكٍ حِمًى، أَلاَ وَ إِنَّ حِمَى اللهِ مَحَا رِ مُهُ، أَلاَ وَإِنَّ فِي الْجَسَدِ مُضْغَةً، إِذَا صَلَحَتْ صَلَحَ الْجَسَدُ كُلُّهُ، وَإِذَا فَسَدَ تْ فَسَدَ الْجَسَدُ كُلُّهُ، أَلاَ وَهِيَ الْقَلْبُ

[رواه البخاري ومسلم]

Artinya: Dari Abu ABdillah Nu’man bin Basyir r.a,”Saya mendengar Rasulullah SAW bersabda, ‘Sesungguhnya yang halal itu jelas dan yang haram itu jelas. Di antara keduanya terdapat perkara-perkara yang syubhat (samar-samar) yang tidak diketahui oleh orang banyak. Maka, barang siapa yang takut terhadap syubhat, berarti dia telah menyelamatkan agama dan kehormatannya. Dan barang siapa yang terjerumus dalam perkara syubhat, maka akan terjerumus dalam perkara yang

Rewards for a pregnant women

1. The Prophet (blessings and peace of Allah be upon him) said: “The woman who dies in pregnancy or childbirth is a martyr.” Narrated by Abu Dawood, 3111; classed as saheeh by al-Nawawi in Sharh Muslim , 13/62.

2. Narrated from Imām as-Sādiq (as):
“Every time a woman becomes pregnant, during the whole period of pregnancy she has the status of one who fasts, one who worships during the night, and one who fights for Allah with her life and possessions. And when she is giving birth, Allah grants her so much reward that nobody knows its limit because of its greatness. And when she is giving milk to her child, for every suck of the child, Allah gives her the reward of freeing a slave from the children of Ismā’īl, and when the period of breastfeeding the child is finished, one of the great angels of Allah taps her side and says: “Start your deeds afresh, for Allah has forgiven all your minor sins.” [ al-Kāfī , vol. 5, pg. 496]

3. The difficulties encountered by the pregnant woman, including pain and sickness, and health, psychological and physical problems in many cases, will all bring great reward that will be recorded for the pregnant woman, in sha Allah. Allah will reward the Muslim for everything that befalls him in this world. Even if a thorn pricks him, Allah will expiate thereby some of his sins, and the pains of labour and pregnancy are far greater than that.

4. The Prophet (Peace be upon him) said:
“The reward of a woman, from the time of pregnancy until birth and breastfeeding, is the same as the reward of one on the path of Allah, and if a woman leaves this world during that time because of the hardship and pains of birth, she has the reward of a martyr.” [ Makarim al-Akhlāq, pg. 238]

5. Imam as-Sadiq (as) narrates From The Prophet (Pbuh) said: "A woman who dies during delivery will not be accountable for her deeds in this world since she has died with the sorrow of childbirth"

6. The Prophet (Peace be upon him) said:
“Paradise is under the feet of the mother.”
